1. Agreement to Terms
By accessing and using CertGuard ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms constitute a legally binding agreement between you (either an individual or entity) and CertGuard regarding your use of our SSL certificate monitoring and website uptime monitoring services.
2. Service Description
CertGuard provides automated SSL certificate monitoring, website uptime monitoring, and related alerting services ("the Service"). The Service includes but is not limited to:
- SSL certificate expiration monitoring and alerts
- Website uptime and availability monitoring
- Certificate chain validation and security analysis
- Response time and performance monitoring
- Multi-channel notifications (Email, Slack, Microsoft Teams, Webhooks)
- Historical analytics and compliance reporting
- Domain watchlist and availability tracking
Important: What CertGuard Is NOT
The Service is NOT a security auditing, penetration testing, vulnerability scanning, or compliance certification platform. CertGuard provides automated monitoring only and does not detect every possible security issue, vulnerability, or misconfiguration. You are responsible for your own security posture and compliance requirements.
3. Service Guarantees and Limitations
3.1 No Guarantee of Availability
While we strive to provide reliable monitoring services, CertGuard does not guarantee 100% uptime or availability of the Service. We provide monitoring on a "best effort" basis and are not responsible for missed alerts, delayed notifications, or service interruptions.
3.2 Monitoring Accuracy
CertGuard monitors your SSL certificates and websites from our servers. Monitoring results may vary based on network conditions, geographic location, DNS propagation, firewall rules, and other factors beyond our control. We do not guarantee the accuracy of all monitoring data.
3.3 Alert Delivery
While we make reasonable efforts to deliver alerts promptly, we cannot guarantee delivery of notifications through third-party services (email providers, Slack, Microsoft Teams, SMS, etc.). You are responsible for ensuring your integration configurations are correct and that you have alternative monitoring in place.
User Configuration Responsibility: You are solely responsible for correctly configuring monitors, alert channels, webhook URLs, email addresses, Slack channels, Teams webhooks, and all integration settings. CertGuard is not responsible for failed alerts caused by misconfiguration, including but not limited to incorrect URLs, disabled notifications, deleted channels, typos, or monitoring the wrong domains.
Third-Party Service Failures: CertGuard is not responsible for delays, failures, outages, rate limiting, or errors caused by third-party platforms including Slack, Microsoft Teams, email providers, SMS providers, DNS hosts, CDNs, or network operators.
4. Limitation of Liability
CRITICAL DISCLAIMER:
CertGuard is a monitoring and alerting tool only. We are NOT responsible for:
- Expired SSL certificates on your websites
- Website downtime or service interruptions
- Loss of business, revenue, or profits
- Data loss or security breaches
- Customer complaints or loss of reputation
- Any consequential, indirect, or punitive damages
YOU ARE SOLELY RESPONSIBLE for renewing your SSL certificates, maintaining your website infrastructure, and ensuring business continuity. CertGuard provides monitoring as a convenience tool to assist you, but the ultimate responsibility for certificate management and website uptime rests with you.
In no event shall CertGuard's total liability exceed the amount you paid for the Service in the twelve (12) months preceding the claim. For free tier users, our liability is limited to AUD $100.
No Professional Advice: Information, alerts, dashboards, reports, and data provided by the Service are for informational purposes only and do not constitute legal, security, compliance, or professional advice. You should consult with qualified professionals regarding your specific security and compliance requirements.
5. Acceptable Use Policy
You agree NOT to:
- Monitor websites or domains you do not own or have permission to monitor
- Use the Service to attack, scan, or probe third-party systems
- Exceed your plan's monitor limits or attempt to circumvent usage restrictions
- Reverse engineer, decompile, or attempt to extract source code from the Service
- Resell, redistribute, or provide access to the Service to third parties
- Upload malicious code, viruses, or engage in fraudulent activity
- Violate any applicable laws or regulations
- Use the Service in a manner that could damage, disable, or impair our infrastructure
Violation of this policy may result in immediate suspension or termination of your account without refund.
6. Subscription and Billing Terms
6.1 Subscription Plans
CertGuard offers Free, Pro, Business, and Enterprise subscription plans. Each plan has specific monitor limits, check frequencies, and feature access as described on our Pricing page. We reserve the right to modify plan features and pricing with 30 days' notice.
6.2 Payment Processing
All payments are processed securely through Stripe, Inc. By subscribing to a paid plan, you authorize CertGuard to charge your payment method on a recurring basis according to your selected billing cycle (monthly or annual). You agree to Stripe's Terms of Service and Privacy Policy.
6.3 Automatic Renewal
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current rate for your plan. We will notify you of any price changes at least 30 days in advance.
6.4 Failed Payments
If a payment fails, we will attempt to process the payment up to 3 times over 7 days. If payment cannot be collected, your account will be downgraded to the Free plan and monitoring may be suspended until payment is received.
6.5 Taxes
Prices are exclusive of applicable taxes (GST, VAT, sales tax, etc.). You are responsible for paying all taxes associated with your subscription. We will add applicable taxes to your invoice based on your billing address.
7. Cancellation and Refund Policy
7.1 Cancellation
You may cancel your subscription at any time through your account dashboard. Cancellations take effect at the end of your current billing period. You will continue to have access to paid features until the end of the billing period you've paid for.
7.2 Refund Policy
We offer a 30-day money-back guarantee for new subscriptions. If you are not satisfied with the Service within the first 30 days of your initial subscription, contact us for a full refund.
After 30 days, subscriptions are non-refundable. We do not provide pro-rata refunds for partial months. Refunds are only issued to the original payment method.
7.3 Account Termination by CertGuard
We reserve the right to suspend or terminate your account for violation of these Terms, fraudulent activity, abuse of the Service, or non-payment. In such cases, no refunds will be provided.
8. Data Collection and Privacy
CertGuard collects and processes data necessary to provide the Service, including:
- Domain names and URLs you choose to monitor
- SSL certificate data (expiry dates, issuers, fingerprints, etc.)
- Website response times and uptime data
- Your account information (email, name, billing details)
- Integration configurations (Slack webhooks, email addresses, etc.)

9. Intellectual Property
All content, features, functionality, and technology underlying the Service are owned by CertGuard and protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, reproduce, or distribute any part of the Service without our express written permission.
10. Service Modifications and Beta Features
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes. We are not liable for any modification, suspension, or discontinuation of the Service.
Beta and Experimental Features
Features labeled as "Beta," "Experimental," "Preview," "Labs," or similar designations may be incomplete, unstable, or subject to change or removal at any time without notice. You use these features at your own risk. CertGuard makes no warranties regarding beta features and they are provided "as is" without support guarantees.
11. Warranty Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
CERTGUARD DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
12. Indemnification
You agree to indemnify, defend, and hold harmless CertGuard, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Expired SSL certificates or website downtime
- Any content you submit or monitor through the Service
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Australia.
Before initiating legal action, you agree to attempt to resolve disputes informally by contacting us at support@certguard.au. We will make good faith efforts to resolve disputes amicably.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and CertGuard regarding the Service and supersede all prior agreements and understandings.

BY USING CERTGUARD, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.
